This Bill provides for the mandatory installation and operation of dashboard cameras in commercial vehicles.

HIS MAJESTY, by and with the advice and consent of the Legislative Assembly of the Province of British Columbia, enacts as follows:

Definitions

1 In this Act:

"commercial vehicle" has the same meaning as in the Commercial Transport Act;

"dashboard camera" means a recording device that is capable of continuously recording the view of the road in front of a commercial vehicle through the commercial vehicle's front windshield at all times when the commercial vehicle is operating.

Installation and maintenance

2 (1) An owner of a commercial vehicle must install and maintain a dashboard camera in the commercial vehicle.

(2) If a commercial vehicle is a leased commercial vehicle, the lessee, instead of the owner, must comply with subsection (1).

Operation

3 An operator of a commercial vehicle must ensure that the dashboard camera in the commercial vehicle

(a) is recording at all times the commercial vehicle is operated, subject to any regulations, and

(b) is not obstructed or prevented from recording.

Regulations

4 The Lieutenant Governor in Council may make regulations referred to in section 41 of the Interpretation Act.

Commencement

5 This Act comes into force on the date that is six months after the date of Royal Assent.
