(4) Anything sent by electronic mail for the purposes of this Act is deemed to be received by the person to whom it is addressed on the third day after it is sent.
(5) This section does not apply to notices or documents of the appeal board.

(2) By the order of the court, the infant, the infant's guardian or a person appointed by the court in the place of the infant may by deed surrender the lease and accept, in its place and for the benefit of the infant, a new lease of the premises comprised in the lease surrendered for the number of lives or for the term of years as provided in the lease surrendered, or otherwise, as the court directs.

(A) to the mailing address shown in the corporate register for the corporation if that head office is in British Columbia, or
(B) to the mailing address shown in the corporate register for any attorney of the corporation;
(iii) in all other cases, to the head office of the corporation, or
(c) by sending it by electronic mail to the last known electronic mail address
(i) of the corporation or of a director, officer or employee of the corporation, and
(ii) used in relation to a licence, permit, certificate, pesticide use notice, order, inspection or investigation under this Act.
(3) Anything sent by registered mail for the purposes of this Act is deemed to be received by the person to whom it is addressed on the 14th day after deposit with Canada Post, unless the person received actual service before that day.
(4) Anything sent by electronic mail for the purposes of this Act is deemed to be received by the person to whom it is addressed on the third day after it is sent.
(5) This section does not apply to notices or documents of the appeal board.

"lockout" includes the closing of a place of employment, a suspension of work or a refusal by an employer to continue to employ a number of the employer's employees, done to compel the employees or to aid another employer in compelling that employer's employees to agree to conditions of employment; .

(a) within 2 years from the date of the grant of probate or the grant of administration or from the date of their appointment, obtain an order for passing their first accounts, and
(b) at the times the court directs, pass their subsequent accounts.
(2) Subject to subsection (3), every trustee, other than an executor, administrator, trustee under a will or judicial trustee,
(a) may, at any time, obtain from the court an order for passing the trustee's first accounts, and
(b) must, at the times the court directs, pass the trustee's subsequent accounts.
(3) Subsections (1) and (2) do not apply if
(a) the accounts are approved or consented to in writing by all beneficiaries, or
(b) the court otherwise directs.
(4) An executor, administrator and trustee, including a judicial trustee, must pass their accounts annually within one month from the anniversary of the grant of probate, of the grant of administration or of their appointment, if so required by notice served on them at the instance of a person beneficially interested in the property covered by the trust.
(5) Despite subsection (4), the court may, on application, make an order it considers proper as to the time and manner of passing the accounts.
(6) If an executor, administrator or trustee fails to pass any accounts under this section or if the executor, administrator or trustee's accounts are incomplete or inaccurate,
(a) the executor, administrator or trustee may be required to attend before the court to show cause why the account has not been passed or a proper proceeding in connection with it taken, and
(b) proper directions, including the removal of a trustee and appointment of another and payment of costs, may be given at chambers or by adjournment into court.
(7) Subsections (1) and (2) do not apply to
(a) the Public Guardian and Trustee, if appointed under Division 11 of Part 6 of the Wills, Estates and Succession Act, and
(b) any executor, administrator or trustee under a will if the date of the grant of probate or grant of administration or of the appointment of the executor, administrator or trustee is before May 1, 1949.

(ii) does not meet the prescribed qualifications.
(3.1) Subsection (3) does not apply if the younger person is accompanied by and under the close personal supervision of a person, other than the person described in subsection (3), who
(a) is 18 years of age or older,
(b) holds a hunting licence other than an initiation hunting licence or is exempted from holding a hunting licence, and
(c) meets the prescribed qualifications.

Wills, Estates and Succession Act

(b) the applicant's lawyer certifies that the applicant's lawyer has
(i) mailed or delivered a notice of the application to the Nisga'a Lisims Government, and
(ii) if the deceased Nisga'a citizen left a will and the Nisga'a Lisims Government requested a copy of it within 30 days of receiving the notice under subsection (1) (a), mailed or delivered a copy of the will to the Nisga'a Lisims Government. , and
(b) by repealing subsection (4) and substituting the following:
(4) If a treaty first nation has standing under section 14 (3) in a judicial proceeding, the court must not grant or reseal probate or administration in respect of the estate of a treaty first nation member of the treaty first nation unless, in addition to satisfying the requirements under subsection (3),
(a) the applicant certifies that the applicant has
(i) mailed or delivered a notice of the application to the treaty first nation, and
(ii) if the deceased treaty first nation member left a will and the treaty first nation requests a copy of it within 30 days of receiving the notice under subsection (3) (a), mailed or delivered a copy of the will to the treaty first nation, or
(b) the applicant's lawyer certifies that the applicant's lawyer has
(i) mailed or delivered a notice of the application to the treaty first nation, and
(ii) if the deceased treaty first nation member left a will and the treaty first nation requests a copy of it within 30 days of receiving the notice under subsection (3) (a), mailed or delivered a copy of the will to the treaty first nation.

1183 Section 41 (1) is amended by striking out "he or she" and substituting "the person" and by striking out "his or her" and substituting "the person's".
1184 Section 43 (4) is amended by striking out "his or her" and substituting "the person's".
1185 Section 46 (1) (b) is amended by striking out "brother, sister" and substituting "sibling".
1186 Sections 53 (1) and 56 (2) are amended by striking out "his or her" and substituting "the will-maker's".
1187 Section 72 is amended by striking out "himself or herself" and substituting "themselves".
1188 Section 85 (2) (a) is repealed and the following substituted:
(a) is only effective if the designation, alteration or revocation
(i) is in writing,
(ii) is not altering or revoking a previous designation that is irrevocable under section 87, and
(iii) is signed by either of the following persons:
(A) the person making it;
(B) another person in the presence and at the direction of the person making it, in which case the signature may be in the name of the person making it or of the person signing, .
1189 Sections 104 (1) and 129 (1) (b) and (2) are amended by striking out "his or her" wherever it appears and substituting "the person's".
1190 Section 122 (1) (b) is amended by striking out "his or her" and substituting "the applicant's".
1191 Section 154 (1) is amended by striking out "he or she" and substituting "the person".
1192 Section 158 (3) (b) is amended by striking out "his or her" and substituting "the personal representative's or person's".
1193 Section 181 (2) (c) is amended by striking out "himself or herself" and substituting "themselves".
Workers Compensation Act
1194 Section 265 of the Workers Compensation Act, R.S.B.C. 2019, c. 1, is amended
(a) by repealing subsection (1) and substituting the following:
(1) Despite anything contained in any other Act, the following amounts due by an employer to the Board or, if an assignment has been made under subsection (7), to its assignee constitute a lien in favour of the Board or its assignee:
(a) an amount due on an assessment made under this Act;
(b) an amount which an employer is required to pay to the Board under this Act;
(c) an amount which an employer is required to pay to the Board on a judgment.
(1.1) A lien described in subsection (1) is payable in priority over all liens, charges or mortgages of every person, whenever created or to be created, with respect to the property or proceeds of property, real, personal or mixed, used in or in connection with or produced in or by the industry with respect to which the employer was assessed or the amount became payable.
(1.2) Subsection (1.1) does not apply in respect of the following:
(a) liens for wages due to workers by their employer;
(b) liens under section 50 (1) of the Temporary Foreign Worker Protection Act. ,
(b) in subsection (3) by striking out "subsection (1)" and substituting "subsection (1.2) (a)", and
(c) in subsection (4), by striking out "subsection (1)" and substituting "subsection (1.2) (b)".
Youth Justice Act
1195 Sections 7 (2), 30, 34 (7) (a) and 35 (2) (b) (iii) of the Youth Justice Act, S.B.C. 2003, c. 85, are amended by striking out "his or her" and substituting "the young person's".
1196 Sections 31 (3), 32.2 (8) (a) and 32.3 (8) (a) are amended by striking out "his or her" and substituting "the person's".
1197 Section 42 (1) is repealed and the following substituted:
(1) A provincial director or person in charge of a youth custody centre may delegate,
(a) in the case of the provincial director, subject to any terms and conditions the provincial director considers necessary or advisable, any of the provincial director's powers, duties or functions under this Act to any person, or
(b) in the case of a person in charge of a youth custody centre, subject to any terms and conditions the person considers necessary or advisable, any of the person's powers, duties or functions under this Act to any person.
1198 The British Columbia Life & Casualty Company Act, 1958, S.B.C. 1958, c. 66, is repealed.
Forest and Range Practices Act
1199 Section 187 (1.1) (b) of the Forest and Range Practices Act, S.B.C. 2002, c. 69, is amended by adding ", as that section read immediately before its repeal," after "section 24.2 of the Forest Act".
Wills, Estates and Succession Act
1200 Section 221 of the Wills, Estates and Succession Act, S.B.C. 2009, c. 13, is repealed and the following substituted:
221 Section 41 (3) to (5) of the Hospital District Act, R.S.B.C. 1996, c. 202, is amended by striking out "or administrator" and substituting ", administrator or small estate declarant".
1201 This Act comes into force on the date of Royal Assent.
