HIS MAJESTY, by and with the advice and consent of the Legislative Assembly of the Province of British Columbia, enacts as follows:

1 Section 27 of the Vital Statistics Act, R.S.B.C. 1996, c. 479, is amended

(a) in subsection (2) (c) by adding "in the case of a minor who is less than 12 years of age," before "a statement from one of the following persons", and

(b) in subsection (5) by striking out "A birth certificate" and substituting "Except as provided under section 36 (2) (d), a birth certificate".

2 Section 36 (2) (d) is repealed and the following substituted:

(d) the sex of the person, unless the applicant for the certificate requests, as part of the application under subsection (1), that the person's sex not be included; .

Commencement

3 This Act comes into force by regulation of the Lieutenant Governor in Council.

Explanatory Notes

CLAUSE 1: [Vital Statistics Act, section 27]

• narrows the requirement for a physician or psychologist to confirm that the sex designation of a person applying for a birth registration amendment does not correspond with the person's gender identity;
• is consequential to the amendment by this Bill to section 36 of the Act.

CLAUSE 2: [Vital Statistics Act, section 36] provides that a person's birth certificate is not required to include the person's sex if the applicant for the certificate requests this.
