HER MAJESTY, by and with the advice and consent of the Legislative Assembly of the Province of British Columbia, enacts as follows:

1 Section 107.1 of the Environmental Management Act, S.B.C. 2003, c. 53, is amended

(a) in subsection (1) by striking out "anything seized by a conservation officer under section 107.02 or 107.03 (2)" and substituting "anything seized by a conservation officer under section 107.02 or 107.03", and

(b) in subsection (3) by striking out "anything seized in a search under section 107.02 or 107.03 (2)" and substituting "anything seized in a search under section 107.02 or 107.03".

Commencement

2 This Act comes into force on the date of Royal Assent.

Explanatory Notes

CLAUSE 1: [Environmental Management Act, section 107.1]

• applies provisions of the Offence Act to searches under section 107.03 (3) and authorizes detention of things seized during those searches for an initial period of up to a year;
• applies restrictions on returning pollutants, environmental hazards and contaminated things to things seized during searches under section 107.03 (3).
