HER MAJESTY, by and with the advice and consent of the Legislative Assembly of the Province of British Columbia, enacts as follows:
1 Section 1 (1) of the Strata Property Act, S.B.C. 1998, c. 43, is amended
(a) by striking out the semicolon at the end of subparagraph (b) (ii) of the definition of "common property" and substituting a comma, and by adding the following after paragraph (b):
"but does not include a standard unit;", and
(b) by adding the following definition:
"standard unit" means that part of a strata lot that includes the sub-floor, walls, ceilings, pipes, wires, cables, chutes, ducts and other facilities for the passage or provision of water, sewage, drainage, gas, oil, electricity, telephone, radio, television, garbage, heating and cooling systems, or other similar services, that are wholly within a strata lot; .
2 Section 59 (4) is amended by striking out the period at the end of paragraph (d) and substituting a semicolon, and by adding the following paragraph:
(e) the current copy of the strata corporation insurance policy obtained in accordance with Part 9.
3 Section 149 is amended by adding the following subsection:
(5) The strata corporation must be provided the terms of the property insurance renewal policy a minimum of 30 calendar days before expiration of the insurance policy.
4 Section 150 is amended by adding the following subsection:
(3) The strata corporation must be provided the terms of the liability insurance renewal policy a minimum of 30 calendar days before expiration of the insurance policy.
5 Section 161 is amended
(a) in subsection (1) by striking out the semicolon at the end of paragraph (d) and substituting a period,
(b) in subsection (1) by repealing paragraph (e), and
(c) by adding the following subsection:
(1.1) Despite the Insurance Act or any other law, an owner of a strata lot that has a floor, wall, or ceiling that forms a boundary with another strata lot must obtain and maintain insurance for liability for property damage and bodily injury occurring on the owner's strata lot, and the insurance must be of at least the amount required in the regulations.
6 This Act comes into force by regulation of the Lieutenant Governor in Council.
