MISCELLANEOUS STATUTES (MINOR CORRECTIONS) AND STATUTE REVISION AMENDMENT ACT, 2019

HER MAJESTY, by and with the advice and consent of the Legislative Assembly of the Province of British Columbia, enacts as follows:

Part 1 – Miscellaneous Statutes
(Minor Corrections) Amendments

Adoption Act

1 Section 91 (2) of the Adoption Act, R.S.B.C. 1996, c. 5, is amended

(a) in paragraph (s) by striking out "(prohibiting payment for an adoption)" and substituting "[prohibiting payment for an adoption]", and

(b) in paragraph (t) by striking out "(prohibiting certain advertising)" and substituting "[prohibiting certain advertising]".

Adult Guardianship Act

2 Section 64 (1) (a) of the Adult Guardianship Act, R.S.B.C. 1996, c. 6, is amended by striking out "section 46 (5)" and substituting "section 46 (4)".

Architects (Landscape) Act

3 Section 8 (1) (c) (i) of the Architects (Landscape) Act, R.S.B.C. 1996, c. 18, is amended by striking out "Kwantlen College" and substituting "Kwantlen Polytechnic University".

Budget Transparency and Accountability Act

4 Section 9 (2) (d) (v) of the Budget Transparency and Accountability Act, S.B.C. 2000, c. 23, is repealed and the following substituted:

(v) information required by sections 25 (2) [amounts received by government], 26 (3) [liabilities in excess of appropriation], 70 (2) and (3) [borrowing transactions and leases] and 74 (3) [payments on guarantees and indemnities] of the Financial Administration Act.

Coastal Ferry Act

5 Section 60 of the Coastal Ferry Act, S.B.C. 2003, c. 14, is amended by striking out the formula and substituting the following:

Community Care and Assisted Living Act

9 Section 1 (1) of the Community Care and Assisted Living Act, S.B.C. 2002, c. 75, is amended in the definition of "hospitality services" by striking out "24 hour" and substituting "24-hour".

Crown Proceeding Act

10 Section 11 of the Crown Proceeding Act, R.S.B.C. 1996, c. 89, is amended

(a) in subsections (2) and (4) by striking out "the government;" and substituting "the government, and", and

(b) in subsection (6) by striking out "the property;" and substituting "the property, and".

Debtor Assistance Act

11 Section 2 (2) (c) of the Debtor Assistance Act, R.S.B.C. 1996, c. 93, is amended by striking out "may employ a person" and substituting "employ a person".

Gaming Control Act

12 Section 28 (1) of the Gaming Control Act, S.B.C. 2002, c. 14, is amended by striking out "to directives," and substituting "to directives".

Health Care (Consent) and Care Facility (Admission) Act

13 Section 34 (2) (a) of the Health Care (Consent) and Care Facility (Admission) Act, R.S.B.C. 1996, c. 181, is amended by striking out "paragraph (d)" and substituting "paragraph (e)".

Income Tax Act

14 Section 4.52 of the Income Tax Act, R.S.B.C. 1996, c. 215, is amended

(a) in subsection (1) (d) by striking out "descriptions of C and F" and substituting "descriptions of "C" and "F"",

(b) in subsection (1) (f) by striking out "description of deduction" and substituting "description of "deduction"",

(c) in subsection (2) (b) (ii) in the description of "B" by striking out "in the description of A" and substituting "in the description of "A"", and

(d) in subsection (7) (c) by striking out "the higher one thousandth" and substituting "the higher one-thousandth".

Insurance (Vehicle) Act

15 Section 46.2 (3) of the Insurance (Vehicle) Act, R.S.B.C. 1996, c. 231, is amended by striking out "Utilities Commissions Act" and substituting "Utilities Commission Act".

Legal Profession Act

16 Section 14 (3) of the Legal Profession Act, S.B.C. 1998, c. 9, is amended by striking out ""Notary Public in and for the Province of British Columbia,"" and substituting ""Notary Public in and for the Province of British Columbia",".

Mineral Tenure Act

17 Section 6.5 of the Mineral Tenure Act, R.S.B.C. 1996, c. 292, is amended by striking out "of a period" and substituting "of a period,".

Pill Press and Related Equipment Control Act

18 Section 17 (1) of the Pill Press and Related Equipment Control Act, S.B.C. 2018, c. 24, is amended by striking out "as if the person was an inspector" and substituting "as if the person were an inspector".

Property Transfer Tax Act

19 Section 1 (1) of the Property Transfer Tax Act, R.S.B.C. 1996, c. 378, is amended in the definition of "execution copy" by striking out "under 13.1 (3)" and substituting "under section 13.1 (3)".

Recall and Initiative Act

20 Section 133.04 (2) (b) of the Recall and Initiative Act, R.S.B.C. 1996, c. 398, is amended by striking out "officer, and" and substituting "officer;".

21 Section 146.13 (1) (b) is amended by striking out "contribution" and substituting "contribution.".

Residential Tenancy Act

22 Section 45.1 (1) of the Residential Tenancy Act, S.B.C. 2002, c. 78, is amended in the definition of "household violence" by striking out "affected a tenant" and substituting "affected a tenant's".

South Coast British Columbia Transportation Authority Act

23 Section 1 (5) (a) of the South Coast British Columbia Transportation Authority Act, S.B.C. 1998, c. 30, is amended by striking out "in the definition of "issuing entity" in section 34.29, 44, 46 (4) (f) and 149 (1)," and substituting "in the definition of "issuing entity" in section 34.29, in sections 44, 46 (4) (f) and 149 (1),".

Taxation (Rural Area) Act

24 Section 3.2 of the Taxation (Rural Area) Act, R.S.B.C. 1996, c. 448, is amended by adding "the" before "Property Transfer Tax Act".

Tobacco Damages and Health Care Costs Recovery Act

25 Section 1 of the Tobacco Damages and Health Care Costs Recovery Act, S.B.C. 2000, c. 30, is amended

(a) by striking out "tobacco related" wherever it appears and substituting "tobacco-related",

(b) in subsection (1) in the definition of "cost of health care benefits" by striking out "be expected will be provided" and substituting "be expected to be provided", and

(c) in subsection (1) in the definitions of "tobacco related disease" and "tobacco related wrong" by striking out "tobacco related" and substituting "tobacco-related".

26 Sections 2, 4 to 8 and 10 are amended by striking out "tobacco related" wherever it appears and substituting "tobacco-related".

University Act

27 Section 67 (10) of the University Act, R.S.B.C. 1996, c. 468, is amended by striking out "Degree Authorization Act" and substituting "Degree Authorization Act".

Witness Security Act

28 Section 58 (5) of the Witness Security Act, S.B.C. 2019, c. 21, is amended by striking out "section 45 (2) (c)" and substituting "section 45 (2) (d)".

Part 2 – Statute Revision Act Amendment

29 The Statute Revision Act, R.S.B.C. 1996, c. 440, is amended by adding the following section:

Consequential amendments to regulations

9.1  (1) In relation to the limited revision of an Act, the Lieutenant Governor in Council may, by regulation, amend a regulation that refers to an Act that has been revised under this Act, for the purposes of

(a) updating references to provisions of the Act that has been revised, or

(b) changing terminology for consistency of terminology with the revised Act.

(2) The authority under subsection (1) applies to all regulations, including regulations made by a regulation-making authority other than the Lieutenant Governor in Council.

Commencement

30  The provisions of this Act referred to in column 1 of the following table come into force as set out in column 2 of the table:
