HER MAJESTY, by and with the advice and consent of the Legislative Assembly of the Province of British Columbia, enacts as follows:
1 The Homeowner Protection Act, S.B.C. 1998, c. 31, is amended by adding the following section:
23.1 (1) The New Homes Registry must certify in writing that a building which has formerly been used as a grow operation for drugs has been adequately remediated, under the following conditions:
(a) that standards and a list of remediation criteria have been developed by the Registry and made public after consultation with the industry;
(b) that an inspection of the building has been undertaken against the standards and criteria, at the cost of the owner of the building, by a Home Inspector licensed under the Business Practices and Consumer Protection Act, who has in turn obtained the written report of a professional engineer, certified electrician, plumber or other tradespeople according to need; and
(c) that the Home Inspector certifies to the Registry that all the standards and remediation criteria have been met.
(2) The certification document is sufficient proof that remediation has taken place.
2 This Act comes into force on the date of Royal Assent.
