TOBACCO AND VAPOUR PRODUCTS CONTROL (VULNERABLE ADOLESCENTS
PROTECTION FROM E-CIGARETTES (VAPE)) AMENDMENT ACT, 2019

HER MAJESTY, by and with the advice and consent of the Legislative Assembly of the Province of British Columbia, enacts as follows:

1 Section 1 of the Tobacco and Vapour Products Control Act, R.S.B.C. 1996, c. 451, is amended by adding the following definitions:

“tobacco stores” is any business that only sells tobaccos and other tobacco product related paraphernalia;

“vaping stores” is any business that only sells e-cigarettes, e-substances, vapour products and other vapour product related paraphernalia.

2 Section 2 is amended by adding the following subsection:

(5) A person must not sell or offer to sell flavoured vapour products.

3 Section 2.1 is amended by adding the following subsection:

(1.1) A person may only deal in, sell, offer for sale or distribute vapour products in the following authorized places:

(a) pharmacy as defined in the Pharmacy Operations and Drug Scheduling Act;

(b) tobacco stores;

(c) vaping stores.

4 Section 6.1 is amended by adding the following subsection:

(6) The administrator has the authority to restrict authorization to sell vapour products if

(a) a business has received three penalties, and

(b) the three penalties were not incurred from the same incident, and

(c) all three penalties occurred within a two-year period.
