FREEDOM OF INFORMATION AND PROTECTION OF PRIVACY AMENDMENT ACT, 2018

HER MAJESTY, by and with the advice and consent of the Legislative Assembly of the Province of British Columbia, enacts as follows:

This Bill would amend the Freedom of Information and Protection of Privacy Act to include "gender identity and expression" as a category of personal information that the head of a public body must refuse to disclose if the disclosure would be an unreasonable invasion of a third party’s personal privacy. This Bill would also amend the Freedom of Information and Protection of Privacy Act to replace gendered language with gender neutral language.

1 Section 3 of the Freedom of Information and Protection of Privacy Act, R.S.B.C. 1996, c. 165 is amended

(a) in subsection (1) (c.2) by striking out "his or her" and substituting "their", and

(b) in subsection (4) by striking out "his or her" and substituting "their".

2 Section 22 (3) (i) is amended by adding ", gender identity or expression" after "sexual orientation".

3 Section 29 (1) is amended by striking out "his or her" and substituting "their".

4 Section 60 (2) is amended by striking out "his or her" and substituting "their".

5 Section 70 (2) is amended by striking out "he or she" and substituting "they".

6 Schedule 1 is amended in paragraph (b) of the definition of "intimate partner" by striking out "boyfriend or girlfriend" and substituting "romantic partner".

Explanatory Note

This Bill would amend the Freedom of Information and Protection of Privacy Act to include "gender identity and expression" as a category of personal information that the head of a public body must refuse to disclose if the disclosure would be an unreasonable invasion of a third party’s personal privacy. This Bill would also amend the Freedom of Information and Protection of Privacy Act to replace gendered language with gender neutral language.
