HER MAJESTY, by and with the advice and consent of the Legislative Assembly of the Province of British Columbia, enacts as follows:
1 In this Act,
"single-use beverage pod" means a container used in a coffee maker to prepare a single serving of coffee or other beverage.
2 (1) No person shall sell or offer for sale at retail a single-use beverage pod unless it is fully compostable.
(2) A single-use beverage pod is fully compostable if it satisfies the requirements prescribed by the regulations.
3 A person who contravenes section 2 is guilty of an offence and on conviction is liable to a fine of not more than $5,000.
4 The Lieutenant Governor in Council may make regulations prescribing requirements for the purposes of section 2 (2).
5 This Act comes into force on the fourth anniversary of the day it receives Royal Assent.
