PROTECTED AREAS OF BRITISH COLUMBIA
AMENDMENT ACT, 2018

HER MAJESTY, by and with the advice and consent of the Legislative Assembly of the Province of British Columbia, enacts as follows:

SECTION 1: [Protected Areas of British Columbia Act, Schedule A] enacts in Schedule A descriptions of 15 ecological reserves, previously established as ecological reserves by orders in council and referenced in Schedule B.

1 Schedule A of the Protected Areas of British Columbia Act, S.B.C. 2000, c. 17, is amended by adding the following descriptions:

CHILLIWACK RIVER ECOLOGICAL RESERVE

All those parcels or tracts of Crown land, together with all that foreshore or land covered by water, situated in Yale Division, Yale District and contained within the described boundaries as shown on the Official Plan deposited in the Crown Land Registry as Plan 11 Tube 2013.

The whole ecological reserve containing approximately 85 hectares.

DOC ENGLISH BLUFF ECOLOGICAL RESERVE

All those parcels or tracts of Crown land, together with all that foreshore or land covered by water, situated in Lillooet District and contained within the described boundaries as shown on the Official Plan deposited in the Crown Land Registry as Plan 14 Tube 2013.

The whole ecological reserve containing approximately 35 hectares.

DRIZZLE LAKE ECOLOGICAL RESERVE

All those parcels or tracts of Crown land, together with all that foreshore or land covered by water, situated in Queen Charlotte District and contained within the described boundaries as shown on the Official Plan deposited in the Crown Land Registry as Plan 15 Tube 2013.

The whole ecological reserve containing approximately 813 hectares.

DUKE OF EDINBURGH (PINE/STORM/TREE ISLETS) ECOLOGICAL RESERVE

All those parcels or tracts of Crown land, together with all that foreshore or land covered by water, situated in Range 1, Coast District and Range 2, Coast District and contained within the described boundaries as shown on the Official Plan deposited in the Crown Land Registry as Plan 1 Tube 2014.

The whole ecological reserve containing approximately 549 hectares (100 hectares of upland and 449 hectares of foreshore).

HONEYMOON BAY ECOLOGICAL RESERVE

All those parcels or tracts of Crown land, together with all that foreshore or land covered by water, situated in Renfrew District and contained within the described boundaries as shown on the Official Plan deposited in the Crown Land Registry as Plan 5 Tube 2014.

The whole ecological reserve containing approximately 7.5 hectares.

KATHERINE TYE ECOLOGICAL RESERVE

All those parcels or tracts of Crown land, together with all that foreshore or land covered by water, situated in Group 2, New Westminster District and contained within the described boundaries as shown on the Official Plan deposited in the Crown Land Registry as Plan 6 Tube 2014.

The whole ecological reserve containing approximately 3.1 hectares.

KINGCOME RIVER/ATLATZI RIVER ECOLOGICAL RESERVE

All those parcels or tracts of Crown land, together with all that foreshore or land covered by water, situated in Range 2, Coast District and contained within the described boundaries as shown on the Official Plan deposited in the Crown Land Registry as Plan 7 Tube 2014.

The whole ecological reserve containing approximately 384 hectares.

KLASKISH RIVER ECOLOGICAL RESERVE

All those parcels or tracts of Crown land, together with all that foreshore or land covered by water, situated in Rupert District and contained within the described boundaries as shown on the Official Plan deposited in the Crown Land Registry as Plan 8 Tube 2014.

The whole ecological reserve containing approximately 149 hectares (122 hectares of upland and 27 hectares of foreshore).

LASQUETI ISLAND ECOLOGICAL RESERVE

All those parcels or tracts of Crown land, together with all that foreshore or land covered by water, situated in Lasqueti Island, Nanaimo District and contained within the described boundaries as shown on the Official Plan deposited in the Crown Land Registry as Plan 9 Tube 2014.

The whole ecological reserve containing approximately 217 hectares.

MOUNT TINSDALE ECOLOGICAL RESERVE

All those parcels or tracts of Crown land, together with all that foreshore or land covered by water, situated in Cariboo District and contained within the described boundaries as shown on the Official Plan deposited in the Crown Land Registry as Plan 11 Tube 2014.

The whole ecological reserve containing approximately 438 hectares.

SKAGIT RIVER COTTONWOODS ECOLOGICAL RESERVE

All those parcels or tracts of Crown land, together with all that foreshore or land covered by water, situated in Yale Division, Yale District and contained within the described boundaries as shown on the Official Plan deposited in the Crown Land Registry as Plan 3 Tube 2015.

The whole ecological reserve containing approximately 59 hectares.

SKAGIT RIVER FOREST ECOLOGICAL RESERVE

All those parcels or tracts of Crown land, together with all that foreshore or land covered by water, situated in Yale Division, Yale District and contained within the described boundaries as shown on the Official Plan deposited in the Crown Land Registry as Plan 4 Tube 2015.

The whole ecological reserve containing approximately 79 hectares.

TORKELSEN LAKE ECOLOGICAL RESERVE

All those parcels or tracts of Crown land, together with all that foreshore or land covered by water, situated in Range 5, Coast District and contained within the described boundaries as shown on the Official Plan deposited in the Crown Land Registry as Plan 8 Tube 2015.

The whole ecological reserve containing approximately 158 hectares.

TRANQUILLE ECOLOGICAL RESERVE

All those parcels or tracts of Crown land, together with all that foreshore or land covered by water, situated in Kamloops Division, Yale District and contained within the described boundaries as shown on the Official Plan deposited in the Crown Land Registry as Plan 9 Tube 2015.

The whole ecological reserve containing approximately 233 hectares.

WOODLEY RANGE ECOLOGICAL RESERVE

All those parcels or tracts of Crown land, together with all that foreshore or land covered by water, situated in Oyster District and contained within the described boundaries as shown on the Official Plan deposited in the Crown Land Registry as Plan 12 Tube 2015.

The whole ecological reserve containing approximately 159 hectares.

SECTION 2: [Protected Areas of British Columbia Act, Schedule B] removes the references to 15 ecological reserves that are added to Schedule A by this Bill.

SECTION 3: [Protected Areas of British Columbia Act, Schedule C]

3 Schedule C is amended

(a) by repealing the name and description of Boya Lake Park and substituting the following:

TĀ CH’ILĀ PARK [a.k.a. Boya Lake Park]

All those parcels or tracts of Crown land, together with all that foreshore or land covered by water, situated in Cassiar District and contained within the described boundaries as shown on the Official Plan deposited in the Crown Land Registry as Plan 10 Tube 2009.

The whole park containing approximately 4 728 hectares. ,

(b) by repealing the name of Brooks Peninsula Park [a.k.a. Muq  qiw  n Park] and substituting the following:

MUQ   QIW   N/BROOKS PENINSULA PARK ,

(c) by repealing the descriptions of Cape Scott Park and Chilliwack Lake Park and substituting the following:

CAPE SCOTT PARK

All those parcels or tracts of Crown land, together with all that foreshore or land covered by water, situated in Rupert District and contained within the described boundaries as shown on the Official Plan deposited in the Crown Land Registry as Plan 8 Tube 2016.

The whole park containing approximately 22 300 hectares (17 328 hectares of upland and 4 972 hectares of foreshore).

CHILLIWACK LAKE PARK

All those parcels or tracts of Crown land, together with all that foreshore or land covered by water, situated in Yale Division, Yale District and contained within the described boundaries as shown on the Official Plan deposited in the Crown Land Registry as Plan 6 Tube 2017.

The whole park containing approximately 9 273 hectares. ,

(d) in the description of Downing Park by striking out "Pavillon-Clinton Road" and substituting "Pavilion-Clinton Road",

(e) in the description of Fintry Park

(i) by striking out "and (2)" and substituting "(2)", and

(ii) by striking out "Sheets 1 and 2." and substituting "Sheets 1 and 2; and (3) Plan EPP69096 prepared by Roger Galibois dated January 6, 2017, on file at the Ministry of Transportation and Infrastructure, Kamloops.",

(f) in the description of Juan de Fuca Park

All those parcels or tracts of Crown land, together with all that foreshore or land covered by water, situated in Range 5, Coast District and contained within the described boundaries as shown on the Official Plan deposited in the Crown Land Registry as Plan 14 Tube 2011.

The whole park containing approximately 220 hectares. ,

(h) in the description of Monkman Park by striking out "Plan 6 Tube 1847." and substituting "Plan 4 Tube 2013." and by striking out "62 867 hectares." and substituting "63 119 hectares.",

(i) by repealing the descriptions of Okeover Arm Park and Otter Lake Park and substituting the following:

OKEOVER ARM PARK

All those parcels or tracts of Crown land, together with all that foreshore or land covered by water, situated in Group 1, New Westminster District and contained within the described boundaries as shown on the Official Plan deposited in the Crown Land Registry as Plan 7 Tube 2013.

The whole park containing approximately 3 hectares.

OTTER LAKE PARK

All those parcels or tracts of Crown land, together with all that foreshore or land covered by water, situated in Osoyoos Division, Yale District and contained within the described boundaries as shown on the Official Plan deposited in the Crown Land Registry as Plan 5 Tube 2016.

The whole park containing approximately 55 hectares. ,

(j) by repealing the name of Roderick Haig-Brown Park and substituting the following:

TSÚTSWECW PARK ,

(k) in the description of Sasquatch Park by striking out "Plan 2 Tube 2003;" and substituting "Plan 5 Tube 2013;", and

(l) in the description of Syringa Park

(i) by striking out "Plan 14 Tube 2006; except (1) Broadwater Road as shown on the Official Plan deposited in the Crown Land Registry as Plan 18 Tube 564 and as also shown on Plan 8924 deposited in the Nelson Land Title Office; and (2) a 30 metre right of way centred on FSR 0022-01, Deer Creek." and substituting "Plan 3 Tube 2020.", and

(ii) by striking out "4 499 hectares" and substituting "4 503 hectares".

SECTION 4: [Protected Areas of British Columbia Act, Schedule D]

4 Schedule D is amended

(a) by repealing the description of Cowichan River Park and substituting the following:

COWICHAN RIVER PARK

All those parcels or tracts of Crown land, together with all that foreshore or land covered by water, situated in Cowichan District and contained within the following described boundaries:

Firstly: as shown on the Official Plan deposited in the Crown Land Registry as Plan 13 Tube 1920; except (1) "Skutz" Indian Reserve No. 7; (2) the Canadian National Railway right of way as shown on Plans 11970S and 12150S; and (3) Skutz Falls Forest Service Roads Projects 6115.00 and 6115.02 (formerly RO 4473).

Secondly: Lot 27 and Lot 31, Block 2A as shown on Plan 1789 deposited in the Victoria Land Title Office.

The whole park containing approximately 1 418 hectares. ,

(b) in the description of E. C. Manning Park

(i) by striking out "and (3) Plan EPC1153 deposited in the Crown Land Registry" and substituting "(3) Plan EPC1153 deposited in the Crown Land Registry; and (4) Plan EPC120 deposited in the Crown Land Registry", and

(ii) by striking out everything after "Plan EPC1255 deposited in the Crown Land Registry." and substituting the following:

The whole park containing approximately 83 670 hectares. , and

SECTION 5: [Protected Areas of British Columbia Act, Schedule E] replaces the description and increases the size of Duu Guusd Conservancy.

5 Schedule E is amended by repealing the description of Duu Guusd Conservancy and substituting the following:

DUU GUUSD CONSERVANCY

All those parcels or tracts of Crown land, together with all that foreshore or land covered by water, situated in Queen Charlotte District and contained within the described boundaries as shown on the Official Plan deposited in the Crown Land Registry as Plan 6 Tube 2007; except (1) Commercial Lease V899472, District Lot 3090, covering foreshore, being the bed of Henslung Bay, containing approximately 2.33 hectares, on Land Act file 0104419 at the Ministry of Forests, Lands and Natural Resource Operations, Queen Charlotte; (2) Commercial Recreation Lease 240935, District Lot 3073, containing approximately 0.39 hectares, on Land Act file 6405327 at the Ministry of Forests, Lands and Natural Resource Operations, Queen Charlotte; (3) Commercial Lease V900086, District Lot 3070, containing approximately 0.4 hectares, on Land Act file 6402891 at the Ministry of Forests, Lands and Natural Resource Operations, Queen Charlotte; and (4) Commercial Lease 240940, covering foreshore as shown on the Legal Description Schedule of the Lease, containing approximately 2 hectares, on Land Act file 6402150 at the Ministry of Forests, Lands and Natural Resource Operations, Queen Charlotte.

The whole conservancy containing approximately 229 107 hectares (144 934 hectares of upland and 84 173 hectares of foreshore).

SECTION 6: [Rescission of orders in council] rescinds the establishment by order in council of 15 ecological reserves, the descriptions of which are added to Schedule A of the Protected Areas of British Columbia Act by this Bill.

Rescission of ecological reserves

6  The following are rescinded:

(a) the establishment of Chilliwack River Ecological Reserve by Order in Council 699/80;

(b) the establishment of the ecological reserve, known as Doc English Bluff Ecological Reserve, by Order in Council 725/81;

(c) the establishment of the ecological reserve, known as Drizzle Lake Ecological Reserve, by Order in Council 2762/73;

(d) the establishment of Duke of Edinburgh (Pine/Storm/Tree Islets) Ecological Reserve by Order in Council 1210/88;

(e) the establishment of the ecological reserve, known as Honeymoon Bay Ecological Reserve, by Order in Council 1554/84;

(f) the establishment of Katherine Tye Ecological Reserve by Order in Council 2171/86;

(g) the establishment of the ecological reserve, known as Kingcome River/Atlatzi River Ecological Reserve, by Order in Council 2866/72;

(h) the establishment of Klaskish River Ecological Reserve by Order in Council 1032/90;

(i) the establishment of the ecological reserve, known as Lasqueti Island Ecological Reserve, by Order in Council 1566/71;

(j) the re-establishment of Mount Tinsdale Ecological Reserve by Order in Council 962/94;

(k) the establishment of the ecological reserve, known as Skagit River Cottonwoods Ecological Reserve, by Order in Council 1104/78;

(l) the establishment of the ecological reserve, known as Skagit River Forest Ecological Reserve, by Order in Council 1583/71;

(m) the establishment of the ecological reserve, known as Torkelsen Lake Ecological Reserve, by Order in Council 3766/75;

(n) the establishment of the ecological reserve, known as Tranquille Ecological Reserve, by Order in Council 3684/71;

(o) the establishment of the ecological reserve, known as Woodley Range Ecological Reserve, by the Woodley Range Schedule in Order in Council 592/96.

 
Related Amendment

Parks and Protected Areas Statutes Amendment Act, 2003

SECTION 7: [Parks and Protected Areas Statutes Amendment Act, 2003, section 4] repeals a not-in-force amendment to the description of Graham-Laurier Park.

7 Section 4 (c) of the Parks and Protected Areas Statutes Amendment Act, 2003, S.B.C. 2003, c. 98, is repealed.

Commencement

8  This Act comes into force on the date of Royal Assent.
