HER MAJESTY, by and with the advice and consent of the Legislative Assembly of the Province of British Columbia, enacts as follows:
SECTION 1: [Pooled Registered Pension Plans Act, section 3] removes references to the Canada Gazette and the British Columbia Gazette that are unnecessary as a result of modifications to the application of section 6 (4) of the Pooled Registered Pension Plans Act (Canada) made by section 3 of this Bill.
1 Section 3 (2) of the Pooled Registered Pension Plans Act, S.B.C. 2014, c. 17, is amended in the Table by striking out "Canada Gazette" in Column 1 and "British Columbia Gazette" in Column 2.
SECTION 2: [Pooled Registered Pension Plans Act, section 3] makes the definitions of "designated province" and "Minister" in the Pooled Registered Pension Plans Act (Canada) inapplicable to the Pooled Registered Pension Plans Act (British Columbia).
2 Section 3 (3) (b) is amended
(a) by adding ""designated province"," after ""common-law partnership",", and
(b) by adding ""Minister"," after ""included employment",".
SECTION 3: [Pooled Registered Pension Plans Act, section 3] eliminates the requirement to publish multilateral agreements and amendments to those agreements in the Gazette, while leaving those agreements and amendments accessible to the public on the Internet or by other means that the minister considers appropriate under section 6 (5) of the Pooled Registered Pension Plans Act (Canada), which is incorporated into the Pooled Registered Pension Plans Act (British Columbia).
3 Section 3 (4) is repealed and the following substituted:
(4) For the purposes of its application under this Act, section 6 (4) [publication – Gazette] of the federal Act must be read as follows:
(4) The minister must cause to be published in the Gazette
(a) a notice of the date on which a multilateral agreement comes into effect with respect to pooled registered pension plans;
(b) a notice of the date on which an amendment to a multilateral agreement comes into effect with respect to pooled registered pension plans; and
(c) if the government of British Columbia withdraws from a multilateral agreement or a multilateral agreement terminates, a notice of the effective date of the withdrawal or termination.
4 The provisions of this Act referred to in column 1 of the following table come into force as set out in column 2 of the table:
