ACTING INFORMATION AND PRIVACY COMMISSIONER CONTINUATION ACT

HER MAJESTY, by and with the advice and consent of the Legislative Assembly of the Province of British Columbia, enacts as follows:

This Bill disapplies a provision of the Freedom of Information and Protection of Privacy Act that causes an acting Information and Privacy Commissioner to cease to hold office when the Legislative Assembly has sat for 20 days after the date of the acting commissioner's appointment.

Provision of Freedom of Information and
Protection of Privacy Act
does not apply

1  (1) In this section, "commissioner" has the same meaning as in the Freedom of Information and Protection of Privacy Act.

(2) Section 39 (2) (c) of the Freedom of Information and Protection of Privacy Act does not apply in respect of an acting commissioner appointed on or after March 17, 2017 under section 39 (1) of that Act.

Repeal

2  This Act is repealed on March 31, 2018 or on an earlier date prescribed by the Lieutenant Governor in Council.

Commencement

3  The provisions of this Act referred to in column 1 of the following table come into force as set out in column 2 of the table:

Explanatory Note
