Corrections to Ministry of Attorney General statutes

1 The following statutes are corrected as set out in the attached Schedule:

(a) Administrative Tribunals Act;

(b) Class Proceedings Act;

(d) Court of Appeal Act;

(e) Court Rules Act;

(f) Election Act;

(g) Electoral Districts Act;

(h) Evidence Act;

(i) Expropriation Act;

(j) Family Maintenance Enforcement Act;

(k) Interpretation Act;

(l) Notaries Act;

(m) Offence Act;

(n) Ombudsman Act;

(o) Patients Property Act;

(p) Power of Attorney Act;

(q) Public Guardian and Trustee Act.

1 Sections 22 (1) and 23 (1) of the Administrative Tribunals Act, S.B.C. 2004, c. 45, are amended by striking out "the appeal tribunal" and substituting "the tribunal".

2 Sections 22 (2) (a) and 23 (2) (a) are amended by striking out "the appeal tribunal's rules" and substituting "the tribunal's rules".

3 Section 19 (6) (g) of the Class Proceedings Act, R.S.B.C. 1996, c. 50, is amended by striking out "favorable" and substituting "favourable".

4 Section 62 (6) of the Coastal Ferry Act, S.B.C. 2003, c. 14, is amended by striking out "subsection (1), is the arbitrator" and substituting "subsection (1), the arbitrator" and by striking out "at the beginning of the each" and substituting "at the beginning of each".

5 Section 25 (5) of the Court of Appeal Act, R.S.B.C. 1996, c. 77, is repealed and the following substituted:

(5) If an appeal or application for leave to appeal has remained on the inactive appeal list for 180 consecutive days, on the 181st day it stands dismissed as abandoned.

6 Section 3 (1) (e) of the Court Rules Act, R.S.B.C. 1996, c. 80, is amended by striking out "section 36 (2)" and substituting "section 40 (4)".

7 Form 1 of the Schedule to the Election Act, R.S.B.C. 1996, c. 106, is amended by striking out "To the District Electorial Officer" and substituting "To the District Electoral Officer".

8 Schedule 2 of the Electoral Districts Act, S.B.C. 1999, c. 31, is amended in the description of North Island by striking out "Albermarle" and substituting "Albemarle".

9 Section 25 (5) (b) of the Evidence Act, R.S.B.C. 1996, c. 124, is repealed and the following substituted:

(b) whether printed or not, purporting to be certified as a true copy or extract by

(i) the minister, head, deputy minister or deputy head of a department of government of the British possession or of the foreign state, or

(ii) the custodian of the original document or the public records from which the copy or extract purports to be made, or .

10 Section 30 (3) of the Expropriation Act, R.S.B.C. 1996, c. 125, is amended by striking out "provided for by by" and substituting "provided for by".

11 Section 43 (4) of the Family Maintenance Enforcement Act, R.S.B.C. 1996, c. 127, is amended by striking out "Section 106 (1) (o)" and substituting "Section 109 (1) (o)".

12 Section 29 of the Interpretation Act, R.S.B.C. 1996, c. 238, is amended

(a) in the definition of "Cascade Mountains" by striking out ", means" and substituting "means",

(b) in the definition of "herein" by striking out "section or Part" and substituting "section or part", and

(c) in paragraph (c) of the definition of "savings institution" by striking out "a extraprovincial trust corporation" and substituting "an extraprovincial trust corporation".

13 The Schedule to the Notaries Act, R.S.B.C. 1996, c. 334, is amended by striking out "MacBride" in both places and substituting "McBride".

14 Section 82 (1) of the Offence Act, R.S.B.C. 1996, c. 338, is amended by striking out "subsection (6)" and substituting "subsection (7)".

16 Section 15 (1) (a) of the Patients Property Act, R.S.B.C. 1996, c. 349, is amended by striking out "disposing mind," and substituting "disposing mind, and".

17 Section 19.1 (4) (a) is amended by striking out "section 1," and substituting "section 1".

18 Form 2 of the Schedule to the Power of Attorney Act, R.S.B.C. 1996, c. 370, is amended by striking out "Cross out one of the following alternatives)" and substituting "(Cross out one of the following alternatives)".

19 Section 26 (1) (b) and (1.1) of the Public Guardian and Trustee Act, R.S.B.C. 1996, c. 383, is amended by striking out "of the Public Guardian and Trustee Act" and substituting "of this Act".
